Viral Media Digital – Terms, Policies & Legal Framework

1. Corporate Identity & Platform Role

Viral Media Digital (“VMD”) is a technology platform corporation providing digital infrastructure, software tools, and ecosystem utilities.

VMD is not a bank, brokerage, investment company, escrow service, legal advisor, financial institution, or securities issuer.

VMD provides technology tools only. All actions, transactions, decisions, and interactions conducted within the platform are executed independently by users.

By accessing or using the VMD website or mobile application, users fully accept these Terms.

2. Account Registration & User Responsibility

Users must register with a valid Gmail account. Users are fully responsible for:

• Account security
• Password protection
• All activities under their account
• Compliance with local laws

VMD is not liable for losses caused by user negligence, credential sharing, or unauthorized access due to weak security practices.

3. Marketplace Policy (Peer-to-Peer Infrastructure)

A) Platform Role

The VMD Marketplace operates as a peer-to-peer (P2P) infrastructure. VMD provides listing tools, digital transaction interfaces, and reporting systems only.

VMD does not act as seller, reseller, distributor, importer, exporter, courier, escrow agent, or insurer.

B) Shipping & Delivery Responsibility

All shipping, packaging, delivery, and logistics are the sole responsibility of the users.

VMD is not responsible for:

• Lost packages
• Shipping delays
• Customs issues
• Incorrect delivery information
• Carrier failures

C) Product Image Standards

To maintain quality standards:

• Product images must use a white background.
• Images must accurately represent the product.
• Descriptions must clearly state condition (new/used).

Event and subscription listings may use creative backgrounds as long as they comply with platform rules.

D) Product Condition Responsibility

Sellers are solely responsible for:

• Product authenticity
• Product condition
• Description accuracy
• Legal compliance

E) Buyer Protection & Evidence-Based Review

Users may report issues such as:

• Non-delivery
• Wrong item received
• Damaged item
• Misrepresentation

Refund review requires verifiable evidence including photos, videos, chat records, and tracking details.

F) Refund Authority

VMD may issue refunds at its sole discretion if sufficient evidence confirms seller failure. Refunds are not guaranteed.

G) Three-Strike Seller Suspension Policy

After three (3) verified failures, a store may be suspended or permanently removed.

VMD may suspend immediately without three strikes in cases involving fraud, illegal content, or platform abuse.

4. Refund Policy

Refunds are evaluated case-by-case.

VMD may:

• Request additional documentation
• Pause investigation
• Deny fraudulent claims
• Limit refund eligibility

Abusive refund behavior may result in account restriction.

5. Wallet & Token Disclaimer

The VMD Wallet is a digital utility interface, not a bank account.

The VMD Token is a digital utility asset intended for internal ecosystem functionality only.

It does not represent equity, shares, securities, ownership rights, or guaranteed returns.

No appreciation, liquidity, or profitability is guaranteed.

6. Games & Reward Systems

VMD may offer games and reward-based activities. Rewards may be limited, adjusted, or discontinued at any time.

Anti-fraud systems may restrict abusive or automated behavior.

7. Privacy Policy

VMD collects limited information necessary to operate platform functionality, including account data, usage logs, transaction records, and communications.

Private Stories may include anti-screenshot and anti-recording protections. Users agree not to attempt bypassing such protections.

VMD may access internal logs for fraud prevention, compliance, and dispute resolution.

VMD does not sell personal data.

8. Intellectual Property

All trademarks, designs, branding, software systems, and code remain exclusive property of Viral Media Digital.

Unauthorized reproduction, scraping, reverse engineering, or copying is strictly prohibited.

9. Limitation of Liability

To the maximum extent permitted by law, VMD shall not be liable for:

• Financial losses
• Marketplace disputes
• Delivery failures
• User misconduct
• Technical interruptions

10. Indemnification

Users agree to indemnify and hold harmless VMD, its founders, officers, directors, and affiliates from claims arising from user conduct.

11. Arbitration & Class Action Waiver

All disputes shall be resolved through binding arbitration under the laws of the State of Florida, USA.

Users waive the right to participate in class-action lawsuits.

12. Force Majeure

VMD shall not be liable for interruptions caused by events beyond reasonable control, including cyberattacks, infrastructure outages, or regulatory actions.

13. Policy Updates

VMD may update these Terms at any time. Continued use constitutes acceptance.
